ISLAMABAD: The Election Commission of Pakistan (ECP) has disqualified Pakistan Tehreek-i-Insaf (PTI) Senator Faisal Vawda in a case involving concealing dual nationality while contesting the 2018 general elections.
The reserved judgement was given by an ECP bench chaired by Chief Election Commissioner (CEC) Sikandar Sultan Raja. Vawda has also been ordered to refund any salary and benefits obtained during his time as an MP within the next two months.
It also removed the notification certifying Vawda’s win in the Senate election last year. Vawda’s vote in the Senate elections held on March 10 as a member of the National Assembly was likewise deemed “illegal.” The ECP stated that Vawda provided a “false affidavit” when filing nomination papers.
The ECP had previously postponed its decision on a petition seeking Vawda’s disqualification for hiding his dual nationality when filing his election candidacy papers on December 23, last year.
The complainant, PPP MNA Qadir Khan Mandokhel, and Faisal Vawda, appeared before an ECP panel during the last hearing. Sikandar Sultan Raja, the CEC, had asked Mandokhail whether he wanted to provide further papers or make other points.
Mandokhel stated that it was the 30th hearing in the matter, but he was unable to obtain answers to his queries. According to the PPP leader, ECP has issued warnings for the past year and a half.
Mandokhel believes Faisal Vawda was a US citizen when he filed his election nomination papers. He claimed that the Returning Officer in question was not penalised because he rejected his documents rather than disqualifying Vawda.
According to the PPP leader, Vawda wrongly stated to the ECP in an oath that he had no foreign nationality. According to Mandokhel, the PTI leader hid his dual citizenship during the vetting of his nomination papers.
Vawda’s attorney denied the charges, claiming that his client had never filed for citizenship in another country. Vawda’s US citizenship was confiscated on May 29, 2018, according to NADRA records, according to his attorney. The ECP has deferred its decision in Vawda’s disqualification case after hearing arguments from both parties.
